Malfoy fired a lethal curse, right? Why is out and walking about? If he's not at Azkaban, he should be in the Wizarding equivalent of Juvenile Detention, shouldn't he? Oh, well, even in JKR's version there is a clear absence of justice or in the Wizarding world.
