I thought Fawkes was with luna? and was not feeling that great? how come he was suddenly back in dumbledicks office again?

He is. He's sorta semi-bonded with Luna, who nursed him back to health, (remember chapters 12&13) and is spying for Harry. He's going to complete bond to Luna when it will humiliate Dumbley the most.
