Entrapment:
Simone's Notes:
In many jurisdictions, entrapment is a possible defense against criminal liability. However, there is no entrapment where a person is ready and willing to break the law and the government agents merely provide what appears to be a favorable opportunity for the person to commit the crime. For example, it is not entrapment for a government agent to pretend to be someone else and to offer, either directly or through an informant or other decoy, to engage in an unlawful transaction with the person. So, a person would not be a victim of entrapment if the person was ready, willing and able to commit the crime charged in the indictment whenever opportunity was afforded, and that government officers or their agents did no more than offer an opportunity. On the other hand, if the evidence leaves a reasonable doubt whether the person had any intent to commit the crime had it not been for inducement or persuasion on the part of some government officer or agent, then the person is not guilty. For example, if a defendant had purchased illegal drugs from an undercover officer, he may be found not guilty if it is determined that the officer initiated the transaction or aggressively pressed the accused to complete it.
Despite the warm morning, Susan trembled over her coffee. Laurel waited patiently for her to calm down enough to talk.
"What's the matter?" she asked. "Did something happen? What did Edward do to you?" Susan shook her head. Laurel reached out to touch her, but the other woman quickly drew back.
"It's okay," Laurel whispered. "You can tell me. You're safe now." Susan looked down into her coffee.
"He hasn't done anything to me," she whispered. Laurel looked on at her.
"You don't have to lie to come for him..." she said.
"I'm not lying!" Susan shouted. The deity pulled back a bit.
"Okay, so what happened?" she asked. Susan breathed in the scent of the cooling coffee below her. Her stomach turned to relive the discomfort she had been witnessing lately.
"Nothing," she said. "It's just..."
"What? What is it?"
"Something about him scares."
Laurel gave her a bit of a funny look. "What do you mean?"
Susan forced her hand to stop trembling on the handle of her cup. "The way he looks at me. I feel like he sees me as a piece of meat."
Laurel already knew this would come, but she did her best to hold back her opinions until she got the full details out of her "friend." "Has he said anything inappropriate to you?"
"No."
"Has he touched you?"
"No... Except..."
"Go on."
Susan pressed her lips together. Somehow, she felt that she had spoken too much already. But yet, she couldn't make herself stop. Susan didn't know how much longer she could keep this to herself. Laurel stirred her coffee for a little bit.
"Take your time if you need to," she said. "Here, have of your coffee to help." The other woman nodded as she took the cup and took a big gulp.
"He kissed me," she mumbled. Laurel pretended to look shocked.
"What?!?" she asked. Susan pressed her lips together again. It stung for her to repeat the whole incident in words. Still, she went on with it.
"It was an accident!" she blurted out. "I was talking to him about my father. One thing led to another and we kissed." She buried her head in her hands and shook it firmly.
"Oh god!" she moaned. "I have f**d this time! Oh god!" The woman lifted it her head. "I'm just worried I'll end up cheating on my fiancee again. Oh, this is bad! Really bad!" Laurel lightly patted her on the shoulder.
"Shhh, did anything else happen?" she whispered. Susan shook her head.
"No," she said, breathless. Laurel gave her a little smile.
"You just had a minor set-back," she said. "Don't let it happen again, okay?" The other woman looked at her with big eyes.
"But... But how?" she asked. Laurel took her hand like a mother to a hurt child.
"I won't let you," the deity promised with a stone serious face. "You can bank on that!" Edward watched them from across the street from a candy store.
He would deal with those ladies later.
